Articles I, II, and III of the Unified Development Code work together to establish the foundation of how land use and development are regulated in the city, and they can be explained to the public in straightforward terms. Article I, General Provisions and Code Framework, explains what the development code is, where it applies, and why it exists. It establishes the code as the City’s official rulebook for how land can be used and developed, applying to all property within the city and, in some cases, areas outside city limits when allowed by law. It is adopted under the City’s legal authority to protect public health, safety, and general welfare and is designed to implement the goals of the Comprehensive Plan. For residents, this article matters because it ensures orderly growth, protects property values and neighborhood character, and helps guarantee that infrastructure such as roads, utilities, and drainage keeps pace with development.
Article II, Definitions and Terminology, serves as the dictionary for the code. It provides clear definitions for technical terms used throughout the document, such as zoning districts, setbacks, and accessory dwelling units, and establishes rules for how measurements like height, lot size, and density are calculated. It also explains how to interpret uses that are not specifically listed. This article is important to the public because it prevents confusion, ensures consistent and fair application of the rules, and helps property owners and developers understand expectations before beginning a project.
Article III, Administration and Procedures, explains how decisions are made and who is responsible for making them. It identifies the roles of the City Council, Planning Commission, Board of Adjustment, and administrative staff, and outlines the processes for submitting applications, holding public hearings, providing notice, and filing appeals. It also establishes timelines and procedural requirements for development approvals. This article is important because it ensures transparency, provides opportunities for public participation, and creates a predictable and fair process for both applicants and the community. Together, these three articles form the structural backbone of the development code by defining its purpose, clarifying its language, and establishing how it is administered.
